3. Client Obligations
a. Project Details
Clients must provide clear and accurate project details, including scripts, directions, deadlines, and any other relevant information. Any changes to the project scope after an agreement may lead to additional charges and adjustments to the delivery schedule.
b. Payment Terms
- Rates: All service rates will be provided upfront and agreed upon before work begins.
- Payment Schedule: Payment is typically required upfront or in installments, as agreed with the client. Full payment may be required before the final project delivery.
- Late Payments: Late payments may incur additional fees. Persistent non-payment may result in the suspension or cancellation of services.
4. Revisions and Modifications
Revisions to the delivered work are subject to the following terms:
- Initial Revisions: Minor revisions (e.g., pronunciation corrections, tone adjustments) are usually included in the original agreement and will be made at no extra cost if requested within a reasonable timeframe.
- Additional Revisions: Revisions beyond the original scope or requiring significant rework may incur additional charges. Clients will be informed of these charges before any additional work is performed.
5. Intellectual Property Rights
a. Ownership
- Client Content: Clients retain ownership of any scripts, materials, or intellectual property provided for the project. By providing these materials, the client grants Tina Stewart a license to use them solely for the purpose of completing the project.
- Voice Recordings: Upon full payment, the client receives the rights to the final voice recording as specified in the agreement. Tina Stewart retains the right to use portions of the recordings for her portfolio, unless otherwise agreed upon in writing.
b. Use of Content
Clients are responsible for ensuring that their use of Tina Stewart’s voice recordings complies with all applicable laws, regulations, and licensing agreements. Unauthorized use, distribution, or modification of the recordings may result in legal action.
6. Confidentiality
Both parties agree to keep all project details, scripts, and other sensitive information confidential, unless required by law or agreed upon by both parties. This confidentiality also extends to any non-disclosure agreements (NDAs) related to specific projects.
7. Cancellations and Refunds
a. Cancellations by the Client
Clients may cancel a project by providing written notice. If a cancellation is made after work has commenced, a cancellation fee may apply, determined by the amount of work completed up to the point of cancellation.
b. Cancellations by Tina Stewart
Tina Stewart reserves the right to cancel a project at her discretion. In such cases, the client will be refunded any payments made for work not completed.
c. Refunds
Refunds will only be issued if services are not delivered as agreed, and Tina Stewart is unable to rectify the issue. Refunds will not be issued for dissatisfaction with the creative content once the agreed-upon work has been delivered.
8. Limitation of Liability
Tina Stewart will not be liable for any indirect, incidental, special, or consequential damages arising from the use of her services or website. The total liability of Tina Stewart for any claim related to these Terms or the services provided will not exceed the amount paid by the client for those services.
9. Governing Law
These Terms are governed by and construed in accordance with the laws of [Insert Jurisdiction, e.g., the State of [Your State], USA], without regard to its conflict of law principles. Any disputes arising from these Terms or the services provided will be resolved in the courts of [Insert Jurisdiction].
10. Dispute Resolution
